1. About these terms

Nexform Growth AI (the “Service”) is provided by Nexform Studio. The Service is for business use only: you confirm that you are using it for the purposes of a trade, business or profession and not as a consumer, and that the person accepting these terms is at least 18 and authorised to bind the business.

2. Your account

  • Give accurate information and keep it up to date.
  • Keep sign-in details secure, use two-factor authentication where required, and tell us promptly about any unauthorised use.
  • You are responsible for everyone you invite to your businesses and for the roles you give them, including who may approve advertising changes.

3. Free trial

New accounts start with a 14-day free trial. No payment card is needed. When the trial ends, your account becomes read-only until you choose a paid plan: your data and connections are kept, but you cannot make changes and scheduled automations pause. We may change or withdraw the free trial for new accounts at any time.

4. Plans, fees and payment

  • Current prices are Starter £39 per month or £390 per year, Growth £99 per month or £990 per year, Agency £249 per month or £2,490 per year. The Agency plan includes 10 businesses; each additional business costs £15 per month (£150 per year), added automatically when you create it. Plan limits (businesses, connected advertising accounts, team seats and AI allowance) are shown on our pricing and billing pages.
  • Prices are in pounds sterling and exclude VAT, which is added where applicable.
  • Fees are charged in advance for each monthly or yearly period and renew automatically until cancelled. Payments are processed by Stripe; by subscribing you authorise recurring charges to your chosen payment method.
  • Plan changes take effect immediately and are pro-rated by Stripe.
  • If a payment fails, Stripe will retry it. If it still cannot be collected, your account becomes read-only until payment is made.
  • We may change our prices by giving you at least 30 days' notice by email. Changes apply from your next renewal after the notice period, and you may cancel before then.
  • Advertising spend is not part of our fees. You pay Google, Meta, TikTok and other platforms directly under your own agreements with them.

5. Cancellation and refunds

You can cancel at any time from Plan & billing → Manage billing. Cancellation takes effect at the end of the current paid period, and you keep access until then. Fees already paid are not refundable, including for partly used periods, except where we cancel for our own convenience (in which case we refund the unused part) or where the law requires otherwise.

6. Using the Service

You must not:

  • use the Service unlawfully, or for misleading, fraudulent or harmful advertising;
  • connect accounts or upload data you have no right to use;
  • try to access another business's data, get round security or usage limits, or disrupt the Service;
  • copy, resell or reverse-engineer the Service except as the law allows;
  • upload malware, or use the Service to send spam.

7. Google, Meta and TikTok

Connecting Google, Meta (Facebook and Instagram) or TikTok accounts lets the Service use those platforms on your instructions. Your use of them remains subject to their own terms and policies, which you must follow. These platforms control their APIs and access levels; they can change or withdraw features, and we may need to adapt or pause an integration as a result. We are not responsible for the platforms' services, decisions (such as ad disapprovals or account suspensions) or data accuracy.

8. Advertising and approvals

  • The Service never activates campaigns, increases budgets or publishes changes without approval by a person with the right role in your business. Campaigns are created paused, and each business can set a spend cap for approvals.
  • You are responsible for every change you approve and for your advertising — its content, targeting, budgets, compliance with advertising rules (such as the UK CAP Code and platform policies) and the results.
  • We do not guarantee any level of performance, ranking, traffic, leads or return on advertising spend.

9. AI output

The AI Marketing Director and content tools generate suggestions automatically. AI output can be incomplete, out of date or wrong, so review it before relying on it or publishing it. You are responsible for decisions made using it and for content you publish.

10. Your data and data processing

  • You own your data, including data from connected accounts and the content you create. You give us permission to host, process and display it only as needed to provide and support the Service.
  • You can export reports and content (PDF and CSV) while your account is active. After your account closes we delete your data as described in our Privacy notice.
  • Data processing. Where we process personal data on your behalf, you are the controller and we are your processor, and this section forms the data processing terms required by Article 28 UK GDPR. We will: process it only on your documented instructions (these terms and your use of the Service); ensure our staff are bound by confidentiality; apply appropriate security measures; use only sub-processors listed in our Privacy notice, under written terms giving equivalent protection, and tell you before adding or replacing one so you can object; help you respond to data subject requests and meet your security, breach-notification and impact-assessment obligations; notify you without undue delay after becoming aware of a personal data breach; delete or return the data when the Service ends unless the law requires us to keep it; and make available information reasonably needed to show compliance.
  • You confirm you have a lawful basis and any notices or consents needed for the personal data you bring into the Service, including for the advertising and analytics tags on your own websites.

11. Intellectual property

We (and our licensors) own the Service, its software and branding. We give you a non-exclusive, non-transferable right to use the Service for your businesses during your subscription. Suggestions you send us may be used to improve the Service without obligation to you.

12. Availability and changes

We work to keep the Service available and secure but do not promise that it will be uninterrupted or error-free, and we may carry out maintenance. We may improve or change features; if we remove a significant feature you rely on, you may cancel and we will refund any prepaid fees for the unused period.

13. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
  • Subject to that, neither of us is liable for loss of profits, revenue, business, goodwill or data, or for indirect or consequential loss — including advertising spend or results.
  • Subject to that, our total liability arising from or in connection with these terms in any 12-month period is limited to the fees you paid us in that period.

14. Suspension and termination

You can stop using the Service and cancel at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, fails to pay, or puts the Service or others at risk; where reasonable we will warn you first. We may end the Service for everyone with at least 30 days' notice and a refund of prepaid fees for the unused period.

15. General

  • We may update these terms. We will give at least 30 days' notice of material changes by email; continuing to use the Service after they take effect means you accept them.
  • Neither of us is responsible for delays caused by events beyond reasonable control.
  • You may not transfer your account without our agreement. We may transfer our rights to a successor business, with notice.
  • If any part of these terms is unenforceable, the rest remains in force. These terms are the whole agreement between us about the Service.
  • These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
